Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the Staccato Coffee mobile application (the “App”) operated by Staccato Coffee House (“we,” “our,” or “us”).

By using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Account Registration

  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the security of your account credentials.
  • You agree to provide accurate and complete information when creating your account.
  • One account per person. Duplicate accounts may be terminated.

2. Ordering and Payment

  • Menu and Pricing: All menu items, prices, and availability are subject to change without notice. Prices displayed in the App include applicable taxes where indicated.
  • Order Acceptance: Placing an order through the App constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including item unavailability.
  • Payment: Payment is processed at the time of order through Apple Pay or other accepted payment methods via Square. All sales are in U.S. dollars.
  • Mobile Order Processing Fee: A flat $0.50 processing fee is added to every order placed through the App to offset transaction and infrastructure costs. The fee is shown as a separate line item at checkout and is subject to applicable sales tax under Texas state law (mandatory service fees on prepared food are taxable).
  • Sales Tax: Texas sales tax is calculated on the combined subtotal and processing fee at the McAllen combined rate (state + local), and is shown as a separate line item at checkout.
  • Order Pickup: Orders must be picked up at our store location. You will receive notifications when your order is ready.

3. Loyalty Program

  • Earning Points: You earn loyalty points on qualifying purchases made through the App. The point rate is displayed in the App and may change at our discretion.
  • Redeeming Rewards: Points can be redeemed for available rewards as shown in the App. Reward availability and point requirements may change.
  • Point Expiration: We reserve the right to expire unused points after 12 months of account inactivity.
  • Non-Transferable: Points and rewards are non-transferable and have no cash value.
  • Program Changes: We reserve the right to modify, suspend, or discontinue the loyalty program at any time.

4. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to gain unauthorized access to our systems or other users’ accounts.
  • Interfere with or disrupt the App’s functionality.
  • Submit false or misleading information.
  • Use automated tools to interact with the App without our permission.

5. Intellectual Property

  • The App, including its design, features, content, and branding, is owned by Staccato Coffee House and protected by intellectual property laws.
  • You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

6. Disclaimers

  • The App is provided “as is” and “as available” without warranties of any kind, whether express or implied.
  • We do not guarantee that the App will be uninterrupted, error-free, or secure at all times.
  • Menu item descriptions and images are for reference only and may not exactly represent the final product.

7. Limitation of Liability

To the maximum extent permitted by law, Staccato Coffee House shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, profits, or goodwill.

8. Modifications to the App and Terms

  • We reserve the right to modify or discontinue the App at any time without notice.
  • We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.
  • Material changes will be communicated through the App or via email.

9. Termination

We may suspend or terminate your account at our discretion, including for violation of these Terms. Upon termination, your right to use the App ceases immediately and any accumulated loyalty points may be forfeited.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hidalgo County, Texas.
